Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Grankin Vladimir ("we," "us," or "our"). By creating an account or using our services, you agree to be bound by these Terms.

1. Intellectual Property Rights

Your Rights: You retain ownership of the content you upload to the service ("Input Content"). We do not claim any ownership rights to your Input Content.

Rights to Generated Content: We grant you a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and create derivative works of the images generated by the service at your request ("Generated Content") for any purpose, including commercial use. We do not transfer any exclusive rights to the Generated Content.

Our Rights to Your Content: To operate and improve the service, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display your Input Content and Generated Content. This includes, but is not limited to, using your generations for our marketing materials, promotional activities, and for training our AI models.

2. Acceptable Use Policy

You agree not to use the service to create, upload, or share any content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or hateful.
• Contains nudity, sexually explicit material, pornography, or depicts sexual violence. The generation of content related to child sexual abuse is strictly prohibited and any such instances will be reported to law enforcement authorities.
• Promotes or depicts gratuitous violence, self-harm, or cruelty to animals.
• Infringes on the intellectual property rights of any third party, including copyrights, trademarks, and patents.
• Impersonates any person or entity or falsely states or otherwise misrepresents your affiliation with a person or entity.
• Contains misinformation, disinformation, or content that is deceptive or misleading.
• Create, access, or use more than one free trial account. Each individual is entitled to only one (1) free trial period. Any attempt to circumvent this limit is strictly prohibited and will result in the suspension or termination of all associated accounts.
• Share your account credentials with any other person or allow any other person to access or use your account. Each account is licensed for use by a single individual only. A single user may access their account on a maximum of two (2) devices. Violation of this rule may result in account suspension pending an investigation.

We reserve the right to review content for compliance with these Terms and to remove any content that violates this policy at our sole discretion.

3. Subscriptions, Payments, and Credits

3.1. Subscription Plans. We offer several subscription plans that grant you a specific number of credits each month. The current plans are:

• A Taste Of It: Includes 1,500 credits per month for €9.
• The Best Pick: Includes 4,500 credits per month for €19.
• Pifly PRO: Includes 15,000 credits per month for €35.

3.2. Changes to Subscription Fees. We reserve the right to change the price of our subscription plans at our sole discretion. We will provide you with reasonable prior notice of any price changes via the email address associated with your account. Any price changes will become effective at the end of the then-current billing cycle.

3.3. Changes to Credit Costs. The amount of credits required to use any feature of the service is subject to change at any time, unilaterally and without prior notice. We reserve the right to adjust the credit cost for generations, enhancements, or any other functions as we see fit to balance system load and operational costs.

4. Disclaimers and Limitation of Liability

The service is provided "as is" without warranties of any kind. You agree that the use of any Generated Content is at your sole risk. You are solely responsible for how you use the Generated Content and for ensuring that your use does not violate any applicable laws or third-party rights.

We are not liable for any damages or losses arising from your use of the service or the Generated Content. Your responsibility for the use of the generation results lies exclusively with you, not with us.

5. Termination

We reserve the right to suspend or terminate your access to the service at any time, for any reason, at our sole discretion. If we terminate your account without cause, we will issue a prorated refund for the remainder of your current subscription plan, calculated based on the specific day of termination.

6. Governing Law

These Terms shall be governed by the laws of Spain.

Estos Términos de Servicio ("Términos") rigen su acceso y uso de los servicios proporcionados por Grankin Vladimir ("nosotros" o "nuestro"). Al crear una cuenta o utilizar nuestros servicios, usted acepta estar sujeto a estos Términos.

1. Derechos de Propiedad Intelectual

Sus Derechos: Usted conserva la propiedad del contenido que sube al servicio ("Contenido de Entrada"). No reclamamos ningún derecho de propiedad sobre su Contenido de Entrada.

Derechos sobre el Contenido Generado: Le otorgamos una licencia perpetua, irrevocable, mundial, no exclusiva y libre de regalías para usar, reproducir, modificar y crear obras derivadas de las imágenes generadas por el servicio a su solicitud ("Contenido Generado") para cualquier propósito, incluido el uso comercial. No transferimos ningún derecho exclusivo sobre el Contenido Generado.

Nuestros Derechos sobre Su Contenido: Para operar y mejorar el servicio, usted nos otorga una licencia mundial, libre de regalías y no exclusiva para usar, reproducir, modificar y mostrar su Contenido de Entrada y Contenido Generado. Esto incluye, entre otros, el uso de sus generaciones para nuestros materiales de marketing, actividades promocionales y para entrenar nuestros modelos de IA.

2. Política de Uso Aceptable

Usted se compromete a no utilizar el servicio para crear, subir o compartir ningún contenido que:

• Sea ilegal, dañino, amenazante, abusivo, acosador, difamatorio o que incite al odio.
• Contenga desnudez, material sexualmente explícito, pornografía o represente violencia sexual. La generación de contenido relacionado con el abuso sexual infantil está estrictamente prohibida y cualquier caso será denunciado a las autoridades.
• Promueva o represente violencia gratuita, autolesiones o crueldad hacia los animales.
• Infrinja los derechos de propiedad intelectual de terceros, incluidos derechos de autor, marcas comerciales y patentes.
• Suplante a cualquier persona o entidad o declare falsamente o tergiverse su afiliación con una persona o entidad.
• Contenga desinformación o contenido que sea engañoso.
• Crear, acceder o usar más de una cuenta de prueba gratuita. Cada individuo tiene derecho a un (1) único período de prueba gratuita. Cualquier intento de eludir este límite está estrictamente prohibido y resultará en la suspensión o terminación de todas las cuentas asociadas.
• Compartir las credenciales de su cuenta con cualquier otra persona o permitir que cualquier otra persona acceda o use su cuenta. Cada cuenta está licenciada para el uso exclusivo de un solo individuo. Un único usuario puede acceder a su cuenta en un máximo de dos (2) dispositivos. La violación de esta norma puede resultar en la suspensión de la cuenta mientras se realiza una investigación.

Nos reservamos el derecho de revisar el contenido para verificar el cumplimiento de estos Términos y de eliminar cualquier contenido que viole esta política a nuestra entera discreción.

3. Suscripciones, Pagos y Créditos

3.1. Planes de Suscripción. Ofrecemos varios planes de suscripción que le otorgan un número específico de créditos cada mes. Los planes actuales son:

• A Taste Of It: Incluye 1,500 créditos al mes por 9 €.
• The Best Pick: Incluye 4,500 créditos al mes por 19 €.
• Pifly PRO: Incluye 15,000 créditos al mes por 35 €.

3.2. Cambios en las Tarifas de Suscripción. Nos reservamos el derecho de cambiar el precio de nuestros planes de suscripción a nuestra entera discreción. Le proporcionaremos un aviso previo razonable de cualquier cambio de precio a través de la dirección de correo electrónico asociada a su cuenta. Cualquier cambio de precio entrará en vigor al final del ciclo de facturación vigente en ese momento.

3.3. Cambios en los Costos de Crédito. La cantidad de créditos necesarios para usar cualquier función del servicio está sujeta a cambios en cualquier momento, de forma unilateral y sin previo aviso. Nos reservamos el derecho de ajustar el costo en créditos para las generaciones, mejoras o cualquier otra función según lo consideremos oportuno para equilibrar la carga del sistema y los costos operativos.

4. Exclusión de Garantías y Limitación de Responsabilidad

El servicio se proporciona "tal cual", sin garantías de ningún tipo. Usted acepta que el uso de cualquier Contenido Generado es bajo su propio riesgo. Usted es el único responsable de cómo utiliza el Contenido Generado y de asegurarse de que su uso no viole ninguna ley aplicable o derechos de terceros.

No somos responsables de ningún daño o pérdida que surja de su uso del servicio o del Contenido Generado. La responsabilidad por el uso de los resultados de la generación recae exclusivamente en usted, no en nosotros.

5. Terminación

Nos reservamos el derecho de suspender o cancelar su acceso al servicio en cualquier momento, por cualquier motivo, a nuestra entera discreción. Si cancelamos su cuenta sin causa justificada, le emitiremos un reembolso prorrateado por el resto de su plan de suscripción actual, calculado en función del día específico de la cancelación.

6. Ley Aplicable

Estos Términos se regirán por las leyes de España.
